Terms of Service

Welcome to Anuron Cloud, a service provided by Anuron Technologies LLC ("Anuron," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, the Anuron Cloud Panel, and all related cloud infrastructure and managed hosting services (collectively, the "Services").

By creating an account, purchasing Services, or otherwise accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Anuron Cloud provides cloud infrastructure and managed hosting services, which may include virtual private servers (VPS), managed WordPress environments, related networking, storage, and support services as described on our website or in your order.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, subject to any applicable service commitments we have made to you in writing.

To use most of the Services you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Services.

You agree not to use the Services for any unlawful, harmful, or abusive purpose. Prohibited activities include, but are not limited to:

• Hosting, distributing, or transmitting illegal content, including child sexual abuse material, malware, phishing sites, or content that infringes intellectual property rights.
• Engaging in or facilitating spam, bulk unsolicited email, or other forms of abuse of email or messaging systems.
• Launching or participating in denial-of-service attacks, port scanning, or other activities that disrupt or attempt to disrupt networks or services.
• Attempting to gain unauthorized access to any systems, networks, or accounts (including those of other Anuron customers).
• Using the Services in a way that places unreasonable load on our infrastructure or interferes with other customers' use of the Services.
• Reselling or sub-licensing the Services without our prior written consent, except as expressly permitted in your plan.

We reserve the right to investigate suspected violations and to suspend or terminate Services that we reasonably believe violate this Acceptable Use Policy or applicable law.

You retain all ownership rights in the content, data, websites, and applications you upload, store, or host on the Services ("Customer Content"). You are solely responsible for the legality, accuracy, and appropriateness of your Customer Content.

By using the Services you grant Anuron a limited, non-exclusive, worldwide license to host, store, transmit, and display your Customer Content solely as necessary to provide the Services to you.

We do not claim ownership of your Customer Content and will not use it for our own marketing purposes. You are responsible for maintaining appropriate backups of your Customer Content. While we implement reasonable technical measures, we do not guarantee against data loss.

Fees for the Services are as stated on our website or in your order at the time of purchase. Unless otherwise stated, fees are billed in advance on a recurring basis (monthly, annually, or as otherwise selected).

You authorize us (and our payment processors) to charge the payment method you provide for all applicable fees, taxes, and any renewal charges. Failure to pay may result in suspension or termination of your Services.

Fees are generally non-refundable except as required by law or as expressly stated in a written refund policy. We may change pricing with reasonable notice; continued use of the Services after a price change constitutes acceptance of the new pricing.

We strive to provide reliable Services and will use commercially reasonable efforts to maintain availability. However, the Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.

Scheduled maintenance, emergency interventions, third-party outages, and events beyond our reasonable control may affect availability. Support is provided according to the level associated with your plan and our then- current support policies.

The Services, including our website, software, documentation, branding, and all related intellectual property, are owned by Anuron Technologies LLC or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works of any part of the Services except as expressly permitted by these Terms or applicable law.

These Terms remain in effect while you use the Services. You may terminate your account at any time through the Anuron Cloud Panel or by contacting support, subject to any minimum term or notice requirements in your plan.

We may suspend or terminate your access to the Services immediately if you breach these Terms, fail to pay fees when due, or if we reasonably believe continued provision of the Services would expose us or others to legal or operational risk.

Upon termination, your right to use the Services ceases. We may delete your Customer Content after a reasonable period following termination, subject to any legal retention obligations. Sections that by their nature should survive (including payment obligations, limitation of liability, and indemnification) will survive termination.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will meet your specific requirements, be uninterrupted, secure, or error-free, or that any defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANURON TECHNOLOGIES LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations; in those cases the above limitations apply only to the extent permitted by law.

You agree to indemnify, defend, and hold harmless Anuron Technologies LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services;
• Your Customer Content;
• Your violation of these Terms or applicable law; or
• Your infringement of any third-party rights, including intellectual property or privacy rights.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be communicated through the Anuron Cloud Panel, email, or other reasonable means.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services and may terminate your account.

These Terms, together with our Privacy Policy and any order or plan- specific terms, constitute the entire agreement between you and Anuron regarding the Services and supersede prior agreements on the same subject.

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision does not constitute a waiver. You may not assign these Terms without our prior written consent; we may assign them freely.

Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and Anuron.
